Several aspects of the incoming federal administration’s policy on immigration will have significant effects on families. Those proposed policy changes include the aggressive deportation of undocumented immigrants, strict border and wall control, enhanced enforcement within the U.S., particularly in sanctuary cities, and the increase of worksite raids, and the elimination of Temporary Protected Status and the DACA programs. This seminar will discuss the effects that these policies will have on the children and families remaining here in the state of New Jersey when a family member is deported or affected by the policy changes detailed herein. Topics for discussion will include: the effect on the ownership and management of assets (real property, bank accounts) and the necessary shift in custody arrangements that will occur, including perhaps the relocation of the child.

Overview: Join us for the DWI Update 2025, a comprehensive seminar focusing this year's changes in DWI representation, discovery, post-conviction relief, plea bargaining, and breath testing. It will also examine immigration, with the advent of the present administration in Washington, D.C., immigration law now provides that any alien-whether a green card or visa holder or undocumented-faces deportation and is rendered inadmissible if convicted of DWI. Learn how our courts are protecting the administration of justice in light of threats to immigrants facing this serious traffic offense in New Jersey. It will also cover post-conviction relief, especially in light of State v. Zingis, where PCR is no longer an unusual extraordinary remedy for unconstitutional convictions, but a requirement for those previously convicted in cases involving Alcotest 7110 breath testing instruments inspected by for breath test coordinator Marc Dennis. Another topic will be prior convictions looking at State v. Zingis and Erlinger v. United States, two recent cases discussing the state's burden in establish the validity of prior convictions and suggesting yet more options in plea negotiations. And it will cover new breath testing technology, where State v. Cunningham proceeds apace as the State seeks to validate use of the Alcotest 9510, now replacing the Alcotest 7110. Northern Ireland (NI) civil rights activists opposed to political, religious, and cultural discrimination found inspiration in Dr. Martin Luther King, Jr. and the U.S. civil rights movement. They modeled many of Dr. King's strategies and tactics in challenging the NI government to end housing and employment discrimination, end gerrymandering of electoral districts, institute a one-person one-vote system, disband the Ulster Special Constabulary militia, and repeal the Special Powers Act. The seminar will compare the two movements, highlight the different ways each government responded, and explain why the NI civil rights movement failed.

Like many prosecuting agencies, the Atlantic County Prosecutor’s Office has experienced an increase in cases and backlog due to Covid-era policies, increases in lower-level, quality-of-life offenses, spikes in juvenile crime, the impact of bail reform, new laws and directives as to drug prosecutions, and much more. The tools available through statute and court rule—Recovery/Drug Court, probation supervision, and supervised release—have not sufficiently met this wave. It was in that context that, in 2022, this agency’s newly appointed County Prosecutor and staff began meeting with outside agencies, businesses, social service organizations, residents and community leaders—each seeking relief from a perpetual cycle of property and occasionally violent crimes, often by the same offenders. By working together with all stakeholders and gathering intelligence, ACPO led an effort that has resulted in the implementation of multiple new prosecutor-led diversion programs that utilize prosecutorial discretion and lean on outside help to create new solutions and approaches to helping both suspects and those impacted by their crime. The presentation will introduce the problem(s) as encountered through direct community engagement and describe in detail the programs that were created, the role of courts, defense, and outside agencies, data and discernable impact thus far. An emphasis will be placed on a violence-interruption diversion program that provides trauma-informed therapy to juveniles and young adults, with input from the providing agency on that program and their experience helping develop prosecutor-led diversion programs across the nation.

In October 2024, the NJDEP issued a proposed rule pitched as aligning the ARRCS, N.J.A.C. 7:26C, and the Technical Requirements, N.J.A.C. 7:26E, with the Aug. 23, 2019, statutory changes to the Site Remediation Reform Act (SRRA 2.0). Chief among those revisions were changes to the ARRCS requiring disclosure of discharges discovered during pre-closing due diligence by prospective purchasers of real property to both the property owner and NJDEP. Such disclosure obligation marks a distinct change in the handling of all appropriate inquiry driven diligence. City of Newark that raised questions regarding the authority of the federal and state courts and the standards to be applied in both labor and employment arbitration cases for enforcing or vacating arbitration awards. This distinguished panel of labor and employment law arbitrators will discuss those standards and share practice tips. It will also cover dispositive motions in labor and employment arbitration, such as motions to dismiss or summary judgement are commonplace during pre-hearing proceedings in employment arbitration or for statutory claims of discrimination raised arising under collective bargaining agreements. While not as common pre-hearing for non-statutory claims in traditional labor arbitrations, motions are a frequent tool for raising procedural or substantive defenses to arbitrability during the hearing itself.
