Keys to Immigration Law Past and Present (a CLE Seminar and Tour)

The San Carlos Institute is one of Florida’s most beautiful and historic landmarks. It was founded in 1871 by Cuban exiles of Key West as an educational, civic, and patriotic center.

Enjoy a special excursion to tour the historic San Carlos Institute, founded in 1871, which served as the cradle of Cuba’s independence movement, followed by a unique, historically-rich CLE discussion which will take place the morning after Election Day. The tour will be led by Rafael Peñalver, an attorney, civic leader and cultural preservationist, who serves as President of the San Carlos’ Board of Directors. Mr. Peñalver has led a 40-year effort to save this iconic landmark as a symbol of Cuba’s freedom. In addition to his efforts with the San Carlo Institute, Mr. Peñalver has a remarkable history as a human rights activist. He has taken on several causes pro bono, targeting discrimination and violations of basic human freedoms in his native Cuba and the United States. In 1987, he led the negotiations that brought a peaceful resolution to the uprisings at the Atlanta and Oakdale federal penitentiaries by thousands of Cuban detainees facing indefinite immigration detention. As founder of Due Process, Inc., he was part of the legal effort that challenged the practice of indefinite immigration detention in the United States, which ultimately led to a Supreme Court ruling which found such detention practices unconstitutional. Mr. Peñalver is a regular guest on a variety of TV news programs on CNN, MSNBC, and Univision, among others.

The CLE panel will also include Laurence Tobey, Esq., who formerly served as a U.S. Consular officer (Deputy Section Chief) for the State Department in Havana from 2002-2005. In this role, Mr. Tobey was responsible for the coordination between USCIS (then INS), the State Department Refugee Program and the U.S. Coast Guard for repatriations from sea, as well as being responsible for the oversight of the Consular Section’s issuance of immigrant visas in line with the goals of the US-Cuban Migration Accords. Mr. Tobey also participated in several rounds of the bilateral review talks on behalf of the State Department, both in Washington D.C. and Havana.Join Mr. Peñalver, Mr. Tobey and other esteemed members of the NJSBA Immigration Law Section for a unique CLE presentation on the history of Cuban migration to the U.S., including past and present immigration practices and trends from Cuba and the political challenges related thereto. The CLE discussion will be followed by the tour of this beautiful landmark and its exhibits on the rich history of Cuban immigration to Florida.
